Bernard Clarke
BERNARD CLARKE is a practising solicitor specialising in commercial litigation and insolvency. He formed Bernard Clarke & Co in February 1999. Prior to this he was a partner with S J Berwin & Co and Memery Crystal.
For the past eleven years, he has been the solicitor to the English Liquidation Committee of BCCI in which capacity he is responsible for advising them on all aspects of the liquidation, including sanctioning commencement of proceedings and approving compromises in those proceedings. He acted as an intermediary in the settlement of claims bought by ex-employees of BCCI.
Bernard Clarke acted for the English Liquidation Committee and the Luxembourg liquidators in a hearing which resulted in an order to discontinue the litigation brought by the liquidators of BCCI SA against the Bank of England.
He is a founder and Underwriting Director of First Legal Indemnity Limited, a managed agency formed to develop and administer insurance products for the legal profession. First Legal Indemnity Limited has facilities with leading insurers. Bernard Clarke heads the underwriting team which consists of solicitors, barristers and insurance experts.
First Legal Indemnity recently prepared the underwriting report in an after the event litigation costs insurance policy with a limit of indemnity of £15.3m. This is one of the largest policies of its kind ever to have been written.
Bernard Clarke was educated at Solihull School, Liverpool University and Cambridge University where he won a blue in rugby football. As well as having degrees in History and Law, he has an MSc in Construction Law and Arbitration and is the author of numerous published articles on after the event litigation costs insurance including a paper prepared for the Society for Advanced Legal Studies on the application of after the event insurance to cases involving the tracing of assets.
